1. Who we are

Selluna is operated by Horison Marketing Group CY Ltd, a company registered in Cyprus.

These Terms govern your use of Selluna, our websites, and our app (together, the "Service"). By creating an account, joining the waitlist, or using the Service in any way, you agree to these Terms.

2. What Selluna is

Selluna is an AI-powered image generation platform for ecommerce and Amazon sellers.

You can:

• Add your brand assets (logo, colors, fonts)
• Import products (e.g. via Amazon URLs)
• Generate Amazon-focused images (main, infographics, A+ content)
• Soon: additional ecommerce visuals (storefronts, social, ads, etc.)

Selluna is for brands, agencies, ecommerce businesses, and individual creators. You must be at least 16 years old to use the Service.

3. Early access phase

Right now, Selluna is in limited early access. During this phase:

• You receive 40 free image credits when you sign up.
• You can use those credits to generate images for your real products.
• Early-access images may be watermarked and not downloadable yet.

We are testing UI/UX, performance under load, and future pricing and subscription models.

We may change or limit features, change how many credits are available, invite only certain users into extended access, or end early access at any time. We'll reflect big changes in these Terms or on the website.

4. Accounts and access

To use the app, you'll need an account. You agree to:

• Provide accurate information
• Keep your login details secure
• Not share your account with people outside your team
• Be responsible for all activity under your account

We may suspend or terminate accounts that abuse the Service, break these Terms, or break laws or third-party rights (e.g. Amazon's rules, IP rights).

5. Credits, pricing and future plans

During early access, the Service is 100% free for testers. Your usage is limited by free credits and/or technical limits we set.

In the future, we plan to introduce monthly/yearly subscriptions and credit-based usage. Payments will be handled through providers like Stripe. We'll communicate pricing clearly on our website and within the app.

When paid plans go live, we'll update these Terms and may ask you to accept the new version before continuing.

Refunds: Once paid plans are live, we may offer refunds in line with our then-current refund policy and applicable law. Details will be shown on our pricing or billing pages when payments are enabled.

6. Your content and rights

You may upload or connect logos, brand assets, product images, product URLs, descriptions, and other materials needed to generate visuals (together, "User Content").

You keep ownership of your User Content.

You grant us a worldwide, non-exclusive, royalty-free licence to:

• Store and process your User Content
• Use it to generate images and operate the Service
• Use anonymised or non-identifiable outputs for improving and testing Selluna internally
• Use anonymised outputs for marketing examples (e.g. on our site, in decks), only when we remove or hide brand-specific identifiers — unless we have your explicit consent

You confirm that you have the right to use and upload the content you provide, your uploads don't infringe anyone else's rights, you won't upload illegal or inappropriate content, and you won't deliberately upload third-party brand assets you don't have the rights to.

7. Ownership of Selluna

We (Horison Marketing Group CY Ltd) own the Service itself, the Selluna brand, logo and design, the code, models, UI, and all underlying technology.

You get a limited, non-exclusive, revocable licence to use the Service as long as you follow these Terms. Nothing in these Terms transfers ownership of Selluna or our IP to you.

8. Generated images and output

When you generate images with Selluna, you own the image outputs for your products (subject to any third-party platform rules, e.g. Amazon).

We keep the right to store those outputs for you in the app and use anonymised/non-identifiable outputs internally and for marketing as described above.

You are responsible for checking that generated images are correct, compliant, and suitable for your products and markets. You are also responsible for ensuring your images comply with marketplace guidelines and for any claims or penalties arising from how you use those images.

9. Prohibited use

You agree not to use Selluna to:

• Break any laws or regulations
• Violate Amazon's or other platforms' terms
• Infringe trademarks, copyrights, or other IP rights
• Promote illegal, harmful, hateful, or abusive content
• Mislead customers (e.g. fake claims, fake certifications)
• Generate visuals for illegal products or obvious counterfeits
• Attack, reverse engineer, or overload the Service
• Share your login widely outside your team or resell access without an agreement

We may suspend or terminate access if we believe you're doing any of the above.

10. Affiliate Program

By participating in the Selluna Affiliate Program, you agree to the following terms.

Commission Structure

Affiliates earn 50% of the monthly subscription value paid by each referred customer, for up to 12 months per referral. Commissions apply to monthly subscription plans only and do not apply to one-time plans, credit bundle purchases, add-ons, or any other fees outside of the core monthly subscription value. A 50% discount will be applied to the first three months for users referred by affiliates.

Payments

Affiliates receive monthly payments once the minimum payout threshold of $50 is reached. Payments are processed via bank transfer at the end of each month. Selluna reserves the right to withhold or deduct commissions in the event of a customer refund, chargeback, or payment reversal relating to a referred subscription.

Cookie & Referral Tracking

Referrals are tracked via a unique affiliate link with a 60-day cookie window. If a referred user clears their cookies, uses a different browser, or accesses Selluna via a different device after the initial click, the referral may not be tracked and no commission will be owed. Selluna is not liable for referrals lost due to technical issues outside of our control.

Self-Referrals

Affiliates are strictly prohibited from referring themselves, their own businesses, employees, or any individual or entity with whom they have a financial relationship in order to earn commission. Any self-referral detected will result in immediate termination of affiliate status and forfeiture of any associated commissions.

Refunds & Chargebacks

If a referred customer requests a refund or initiates a chargeback, any commission earned on that transaction will be deducted from future payouts or reclaimed where payment has already been made.

Affiliate Responsibilities

Affiliates must use their unique referral link when promoting Selluna and may not engage in fraudulent or unethical promotional tactics. Affiliates must adhere to all applicable laws, including GDPR and CAN-SPAM, when promoting the platform and communicating with their audience.

Brand & Content Guidelines

Affiliates must not misrepresent Selluna's services, make false or exaggerated claims about the platform, or use Selluna's branding, logos, or trademarks in any way that has not been explicitly approved. Selluna reserves the right to request the removal of any content that violates these guidelines. Failure to comply may result in termination of affiliate status.

Prohibited Activities

The following activities will result in immediate termination of affiliate status and forfeiture of any unpaid commissions: click fraud, spamming, self-referrals, misrepresentation of Selluna's services, unauthorised use of Selluna's branding, or any other unethical or unlawful promotional practices.

Commission Modification

Selluna reserves the right to modify the commission structure, payout threshold, payment method, or any other aspect of the affiliate program at any time. Affiliates will be given a minimum of 30 days' notice of any material changes. Continued participation in the program following notice of changes constitutes acceptance of the updated terms.

No Guarantee of Earnings

Participation in the Selluna Affiliate Program does not guarantee any level of income or earnings. Selluna makes no representations or warranties regarding the amount of commission any affiliate may earn. Results will vary based on individual effort, audience size, and other factors outside of Selluna's control.

Dormancy

If an affiliate account shows no referred customers and no promotional activity for a period of 6 consecutive months, Selluna reserves the right to close the account and forfeit any unpaid commissions below the minimum payout threshold.

Termination

Selluna reserves the right to suspend or terminate affiliate participation at any time for any breach of these terms or engagement in unethical practices, with or without prior notice. Upon termination, any commissions accrued but not yet paid may be forfeited at Selluna's discretion.

Data Protection

Affiliates must comply with Selluna's Privacy Policy and all applicable GDPR guidelines when handling or processing user data obtained through their promotional activities. Affiliates may not collect, store, or share user data in any way that violates applicable data protection laws.

11. No guarantees on results

We share example numbers (like time saved, CTR or conversion increases) based on testing and experience, but we do not guarantee specific performance results. Your actual results may differ based on many factors including product, pricing, competition, and traffic quality.

You use the Service at your own risk and judgement.

12. Third-party services

Selluna may integrate with or rely on hosting providers (e.g. Vercel), analytics tools, payment processors (like Stripe), and communication tools. These services have their own terms and privacy policies. We're not responsible for their content or actions.

13. Community and Discord

We may invite you to a Discord server or other community space. By joining, you agree to basic community rules: no spam, no harassment, no hate speech, no sharing private or confidential information without consent.

We may moderate or remove content and users at our discretion to keep the space safe and useful.

14. Limitation of liability

To the maximum extent allowed by law, we are not liable for lost profits, lost revenue, lost opportunities, indirect or consequential damages, or any loss related to marketplace decisions about your listings, rankings, ads, or account.

Our total liability connected to the Service is limited to the amount you paid us in the last 3 months before the issue — or €0 if the Service was free during that time.

Nothing in these Terms excludes liability where it cannot be excluded by law.

15. Changes to the Service and Terms

We may update features, early access conditions, and these Terms. When we make significant changes, we will update the "Last updated" date and, where appropriate, notify you via the app, email, or website.

If you keep using the Service after changes are published, you accept the new Terms.

16. Governing law and disputes

These Terms are governed by the laws of Cyprus. Any disputes will be handled by the courts of Cyprus, unless mandatory local law in your country gives you other rights as a consumer.
